Welcome to MemoKart, a brand of House of Artsy Creations.
These Terms & Conditions apply when you use MemoKart.com, submit photographs, place an order, make a payment, approve a preview, or purchase a Photo Composition or Memory Frame from MemoKart through our website, WhatsApp, or other official channels.
By proceeding with an order or asking us to begin work, you confirm that you have read and accepted these Terms.
1. Photo Composition & Memory Frames
MemoKart creates personalized Memory Frames and realistic Photo Compositions / Photo Merging.
Our work may include combining people from different photographs and adjusting body references, positioning, clothing, backgrounds, lighting, shadows, colors, image quality, and missing visual details.
Each order is individually created using customer-provided photographs and is therefore a customized and personalized order.
2. Use of Artificial Intelligence (AI)
MemoKart primarily uses professional photo-editing and composition techniques.
Where appropriate, we may also use AI-assisted tools to improve the Photo Composition output, including for:
- Body references
- Background creation or extension
- Missing visual areas
- Clothing or pose references
- Image enhancement
- Other supporting visual elements
AI-assisted elements may be manually reviewed, corrected, blended, and refined by our team.
AI is used as an assisting tool and does not mean every Photo Composition is completely AI-generated.
3. Customer Photographs
Customers should provide the best-quality photographs reasonably available.
The final result may be affected by low resolution, blur, damage, poor lighting, extreme camera angles, cropped faces, partially visible details, or missing visual information.
Customers must ensure they have the necessary permission or authority to provide the photographs to MemoKart.
MemoKart is not responsible for disputes arising from photographs submitted without proper authorization.
4. Facial Similarity & Final Output
MemoKart makes reasonable efforts to preserve the identity and appearance of the people in the photographs.
However, 100% facial similarity or exact photographic reproduction cannot be guaranteed.
The achievable result depends on the quality and visibility of the source photographs.
Where certain details are unavailable, reasonable technical or creative interpretation may be required for areas such as body structure, pose, clothing, hands, hair, background, lighting, or other missing details.
5. Customer Instructions
Customers must clearly communicate important requirements before Photo Composition begins, including:
- Persons to be added
- Preferred positioning
- Body or clothing requirements
- Background preference
- Frame size
- Any important details to include or avoid
Requirements that were not communicated before work began may be treated as additional changes.
6. Payment Terms
A 50% advance payment is required before Photo Composition work begins.
The remaining 50% balance must be paid after completion and preview approval, before delivery of the final high-quality file and/or printing.
Once Photo Composition work has started, the advance payment is non-refundable, as it covers work already performed on the personalized order.
If MemoKart is unable to complete an order for reasons attributable to MemoKart, any applicable refund will be handled according to the work already completed and the circumstances of the order.
7. Preview, Approval & Printing
A preview will be shared with the customer for review.
Customers should carefully check:
- Faces
- Positioning
- Body appearance
- Clothing
- Background
- Colors
- Cropping
- Text, if applicable
- Overall composition
Once approved, the Photo Composition will be considered final for printing.
For Memory Frame orders, printing will proceed after the required approval and payment conditions are completed.
Once printing has started, changes based on personal preference may require additional editing or reprinting charges.
This does not apply to genuine printing defects, damaged products, or incorrect products attributable to MemoKart.
8. Revisions & Major Changes
Reasonable revisions may be provided within the originally confirmed requirements.
Normal revisions may include reasonable corrections to blending, lighting, color, background details, or visible editing issues.
Major changes may require additional payment, including:
- Replacing the original photograph
- Changing the person
- Changing the body reference
- Major position changes
- Changing the background concept
- Requesting a completely different composition
- Adding new requirements after substantial work is completed
9. Digital Preview & Printed Output
We make reasonable efforts to maintain accurate colors between the approved digital preview and printed Memory Frame.
However, slight differences may occur because of screen brightness, monitor settings, printing processes, materials, lamination, or lighting conditions.
Small and reasonable differences are not normally considered defects.
10. Order Timeline
Photo Composition / Soft Copy: 3–6 working days
Delivery after dispatch: 3–7 days
Urgent orders may be prioritized where possible.
These are estimated timelines and may be affected by customer response delays, revisions, changed photographs, pending approvals or payments, courier delays, holidays, technical issues, or circumstances beyond our reasonable control.
11. Customized Orders & Cancellation
All Photo Compositions and Memory Frames are customized specifically for each customer.
Once work has started, orders cannot normally be cancelled, returned, exchanged, or refunded simply because the customer changes their mind, preferred photograph, position, or design preference.
If a customer requests cancellation before work begins, MemoKart may consider it based on the status of the order.
Once work has started, the advance payment is non-refundable.
12. Damaged or Incorrect Products
Replacement may be available if:
- The Memory Frame arrives broken
- The product is damaged during delivery
- The wrong product is received
- There is a genuine manufacturing or printing defect attributable to MemoKart
Customers must contact MemoKart within 24 hours of delivery.
A continuous unboxing video showing the package being opened and clearly showing the issue is required for damage or incorrect-product claims.
Claims without sufficient evidence may not be accepted.

13. Customer Delays
If a customer does not respond regarding photographs, instructions, revisions, approval, payment, or delivery information, the order may be placed on hold.
Time spent waiting for the customer's response is not included in the normal Photo Composition timeline.
The order may resume once the required information or payment is received, subject to current workload.
14. Final Digital File & Delivery
The final high-quality digital file will normally be provided after the required payment has been completed.
Preview files may contain reduced resolution, watermarks, or other preview protection.
For physical Memory Frames, customers are responsible for providing accurate recipient name, address, PIN code, phone number, and delivery details.
Additional courier or re-delivery charges may apply where delivery fails because of incorrect customer-provided information, refusal of delivery, or similar customer-related reasons.
15. Customer Photos & Privacy
Customer photographs and personal information are handled according to our Privacy Policy.
Photographs may be processed or stored through systems reasonably required for completing the Photo Composition, including:
- Local computers
- Mobile devices
- Cloud storage
- Photo-editing software
- AI-assisted editing platforms
- Backup systems
Because photographs may exist across multiple working systems, MemoKart does not guarantee automatic deletion immediately after completion.
Customers may request deletion of eligible photographs or personal information according to our Privacy Policy and applicable requirements.
16. Promotional Use of Completed Work
MemoKart may use selected:
- Completed Photo Compositions
- Memory Frame photographs
- Before-and-after examples
- Customer reviews
- Feedback
- Final outputs
for social media, website portfolio, advertisements, sample works, or other promotional purposes.
We do not necessarily publish every customer's work.
Customers who do not want their photographs or completed work used publicly may inform MemoKart through our official channels.
MemoKart will honor reasonable requests not to publicly use such work.
Customers may also request removal of eligible previously published content.
17. Customer Rights & MemoKart Content
Customers retain whatever lawful rights they hold in photographs submitted to MemoKart.
By submitting photographs, customers give MemoKart permission to process, edit, crop, enhance, merge, reconstruct, store, transmit, and otherwise use those photographs as reasonably necessary to complete the requested Photo Composition.
The MemoKart name, logo, website content, graphics, promotional materials, layouts, and other original brand content may not be copied, reproduced, resold, or commercially used without permission.
18. Prices, Third-Party Platforms & Order Refusal
Prices and offers may change from time to time.
Once an order price is confirmed, it will normally apply to the confirmed requirements. Additional charges may apply where the customer later requests additional work.
MemoKart may use third-party platforms for payments, WhatsApp communication, cloud storage, AI-assisted editing, website hosting, courier delivery, and file transfer.
MemoKart is not responsible for temporary failures caused entirely by independent third-party platforms outside our reasonable control.
MemoKart may refuse or stop orders involving suspected fraud, unlawful activity, unauthorized use of photographs, misleading impersonation, harassment, or other content that cannot reasonably or lawfully be processed.
19. Limitation of Responsibility
To the extent permitted by applicable law, MemoKart will not be responsible for problems caused by:
- Incorrect customer instructions
- Unauthorized photographs
- Poor-quality source photographs
- Customer misuse of completed Photo Compositions
- Incorrect delivery information
- Customer delays
- Circumstances outside MemoKart's reasonable control
- Failures caused solely by independent third-party platforms
Nothing in these Terms removes any customer right that cannot legally be excluded under applicable Indian law.
20. Changes, Governing Law & Contact
MemoKart may update these Terms & Conditions from time to time.
For existing orders, the Terms applicable when the order was confirmed will generally apply unless a change is required by applicable law.
These Terms are governed by the applicable laws of India.
If a disagreement occurs, customers are encouraged to contact MemoKart first so that both parties can attempt to resolve the matter directly.
Nothing in these Terms prevents a customer from exercising any applicable consumer right or approaching an appropriate authority, consumer commission, or court.

By placing an order, submitting photographs, making the advance payment, or asking MemoKart to begin Photo Composition work, you confirm that you have read, understood, and accepted these Terms & Conditions.
